If you are a “consumer” and the Consumer Protection (Distance Selling) Regulations 2000 apply you will be given details of your right to cancel along with the required written information when SAS-Go accepts your booking in writing. SAS-Go reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no agreement arises and SAS-Go will return any payment accompanying the booking. The agreement is between SAS-Go and the customer(s) and it is the sole agreement between those parties. No variation of these Terms and Conditions shall be applicable unless agreed in writing by SAS-Go before the relevant course. The agreement is governed by English Law. Section 2. PaymentFull payment is required for courses that are due to start in 8 weeks or less. No deposit is taken in this case and the full amount is payable. For courses due to start in 8 weeks or more, 50% of the course fee is payable as a deposit to secure the booking. This is non-refundable. Please see our customer cancellation policy under Section 6. You will be sent an email reminder 10 weeks prior to the course start date, prompting you to pay the remaining 50%. Email is not guaranteed to be delivered and it is the customers’ ultimate responsibility to check when payments are required. The balance of the fee (50%) as specified on the booking confirmation must be paid in full, 8 weeks prior to the commencement of your course. If is not paid SAS-Go reserves the right to treat the agreement as cancelled by the customer(s) and the customer(s) will forfeit their 50% deposit. It is recommended that the customer(s) may take out personal insurance to cover cancellation losses and if travel costs are likely to be high it is advisable to check course viability before booking travel tickets. Section 3. Booking and Consent FormThe customer(s) acknowledges that they must sign and complete the Booking and Consent Form which must be returned to SAS-Go . The Booking and Consent Form is downloadable from the Courses Section at www.sas-go.co.uk Section 4. Gift VouchersGift vouchers are non-refundable. Vouchers are valid for one year from either date of issue or from the date of a provisional booking made at the time of purchase and they can be redeemed for equivalent monetary value on any SAS-Go Course. Vouchers can be re-sold or given to a third party. Once a provisional booking has been confirmed by the recipient of the voucher, it becomes a confirmed booking and the cancellation conditions described in Section 6 apply. If a provisional booking is not confirmed before 8 weeks of the course start date, the provisional place may be lost and the recipient may have to book another date. The purchaser of the voucher has a responsibility to ensure the recipient is aware of these Terms and Conditions, Arrival Instructions and other booking details supplied with the voucher. Section 5. Cancellation by SAS-Go LtdCancellation occurs when SAS-Go informs the customer(s), for any reason, that a course will not run. Should SAS-Go have to cancel a course, the customer(s) will be offered an alternative date. If this is not acceptable, the booked customer(s) will be eligible for a full refund. Section 6. Cancellation by the customer(s)Where the customer is a consumer the remaining paragraphs of this section 6 do not apply to a cancellation in accordance with the customers statutory rights (if any) under the Consumer Protection (Distance Selling) Regulations 2000. Cancellation otherwise occurs when the customer(s) instructs SAS-Go that they are unable to attend a booked course (for any reason). Customers agree to the following terms:
The customer(s) acknowledges that it is reasonable for such cancellation terms to apply, given the need for SAS-Go to make preparations for a course substantially in advance of the course. Section 7. Course Date ChangesShould the customer(s) wish to change the dates of their course, and there is a place available, an administration fee of £25.00 will be charged to make the transfer. Section 8. Variation of a course by SAS-Go LtdAn SAS-Go course is, by its very nature, exposed to natural variations including the weather. Whilst every reasonable effort is made to deal with such variations there may be occasions when SAS-Go is forced to vary or modify a course itinerary at short notice. The customer(s) acknowledges that information about courses provided by SAS-Go is given in the best of faith but that because of the variability of nature it may be reasonable for SAS-Go to modify a course itinerary and that, in such circumstances, no right of cancellation will arise. Section 9. The conduct on a courseParticipants are expected to follow all safety instructions and not to act in any way that compromises the safety, enjoyment, learning or well being of themselves, other participants, or staff. SAS-Go will not tolerate abusive behaviour of any kind. Alcohol is not allowed. All recreational and illegal drugs are strictly prohibited. Participants must not to light any unauthorised fires. Axes are not permitted. SAS-Go requires that the participants(s) use only fixed bladed knives rather than folding knives and no cutting tools should be used prior to the safety briefing on the use of those tools. SAS-Go reserves the right to remove from a course any participant that does not follow the above rules and guidelines or in the instructor's judgment pose a safety risk. Any participant so removed will not receive a refund or any compensation. SAS-Go may ask a participant to withdraw from a course, without refund, if they are found to suffer from a physical or mental condition that, in the instructor's judgment, poses a threat to safety. If a prospective participant is in any doubt about this they must discuss their condition with the Lead Instructor in advance of booking the course and, if the Lead Instructor deems it necessary, to seek medical advice. In addition, participants are asked to be respectful of other participants and staff. For example; with respect to noise (mobile phones should be switched off or in silent mode). Participants should also to be respectful of the privacy and property of surrounding landowners and other land users. The participant(s) should be aware that other persons attending an SAS-Go course are entitled to expect a high standard of conduct and regard for the personal well being of all participants. For this reason participant(s) must accept that SAS-Go may, in its absolute discretion and without the need to give reasons, arrange for him or her to be removed from a course, if necessary against his or her will. Circumstances in which this might occur include, without limitation, disorderly or abusive conduct or intoxication. In such circumstances the customer will not be entitled to a refund of monies and SAS-Go will not be liable for any losses so resulting. The Customer will, on demand, reimburse SAS-Go its reasonable costs of effecting such a removal of a participant from a course they have booked. Section 10. Food and RefreshmentsAll courses are on a self catering basis unless otherwise agreed when booking. In this instance, special dietary requirements must be notified by the customer(s). Refreshments including tea, coffee, water and squash are provided at selected points in the day. Section 11. LiabilitySAS-Go courses take place in the open countryside and are by their very nature they are not absolutely free from hazard. SAS-Go makes every effort to minimise the risk to the customer(s) and instructs the customer(s) in the safe negotiation of such risk as may remain. Consequently, while all reasonable efforts will be made to ensure the safety and well being of our customers, because courses take place in an outdoor environment the customer(s) must be aware, understand and agree that there are inherent dangers and certain unpredictability accompanying the courses. The customer(s) accepts responsibility for such risks to personal safety. The customer(s) accepts that to that extent he or she is taking part in an SAS-Go course at his or her own risk. SAS-Go will not be liable for any injury that results from failure to follow its safety instructions. SAS-Go only accepts liability for physical injury to a participant that is shown to result from negligence on the part of SAS-Go. The customer(s) acknowledges that other loss, damage and expense including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused other than by the negligence of SAS-Go howsoever arising is not the responsibility of SAS-Go and that SAS-Go’s liability is hereby limited. Lockers are provided for personal possessions if any participants wish to use them, but such lockers are not supervised and SAS-Go will not be liable for the loss of or damage to any possessions stored in the lockers. Section 12. ComplaintsIn the unlikely event that the customer(s) has/have cause for complaint about an SAS-Go course, the complaint should be made in the first instance to the Lead Instructor so that corrective action can, if necessary, be taken. The customer(s) acknowledges that it is unreasonable to take no action during a course but to complain later. However, should a problem not be resolved the complaint should be made in writing within 28 days to the registered address as above. To the extent permitted by law SAS-Go will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course. Section 13. Subsequent instructions by customer(s)All SAS-Go courses are taught by highly experienced & capable leaders, however, it is not intended that any instruction that is given to any customer(s) while on a course will in any way qualify that or those customer(s) to instruct any third party and no warranty is made to that effect.
